A federal jury in Wilmington, Delaware has awarded Susman Godfrey LLP client Green Mountain Glass LLC more than $50.3 million in its patent infringement lawsuit against Ardagh Glass, Inc. The jury found Ardagh, formerly known as Saint-Gobain Containers, willfully infringed Green Mountain’s patent No. 5,718,737 for technology that allows glass manufacturers to use recycled glass of mixed colors.
“We are gratified that the jury found in favor of our client,” said Susman Godfrey partner Justin A. Nelson, lead counsel to Green Mountain Glass.
The technology patented by Green Mountain allows glass manufacturers to use recycled glass known as “mixed color cullet,” which allowed Ardagh to save money on raw materials and energy, reduce emissions and extend glass furnace life when compared with the use of other raw materials. The patent infringement suit alleged Ardagh made use of this technology without licensing it from Green Mountain.
“This verdict is a vindication of our position and we are grateful for the jury’s decision,” said Green Mountain President Tony Lame.
